Terms and conditions

1. Who we are

WattGames is a service of Truly sport, Liefkenshoek 4, the Netherlands ("we", "us"). WattGames lets gyms and athletes race each other on connected fitness machines through the website and the iPhone and iPad app (together, the "Service").

2. Accounts

• You need an account to use the Service. Give correct details and keep your password to yourself.
• You must be at least 16 years old to create an account yourself.
• You are responsible for what happens under your account.
• A company owner or coach can add members. They must have the member's permission and pass on the temporary password safely.

3. Companies and subscriptions

• Subscriptions are meant for gyms and other businesses. They are bought on the website, per company, per month or per year.
• Prices are shown excluding VAT. VAT is added on your invoice where it applies.
• Payment is handled by Stripe. A subscription renews automatically at the end of each period until it is cancelled.
• You can cancel at any time under "Manage subscription". The subscription then stays active until the end of the paid period.
• If you delete your company or account, the subscription stops immediately and paid amounts are not refunded.
• If we change a price, it applies to new subscriptions. For a running subscription we tell you at least 30 days before a change takes effect, so you can cancel first.
• If a payment fails and is not fixed, we may suspend or end the subscription.

4. Your health and safety

Racing on fitness machines is physically demanding. You train at your own risk. Stop if you feel unwell and talk to a doctor if you are unsure whether you can train hard. Gyms are responsible for safe equipment, supervision and instruction in their own location.

5. Fair use

• Do not manipulate results, machines or rankings, and do not use someone else's account.
• Do not break, overload or try to get around the security of the Service.
• Do not upload anything unlawful, offensive or that infringes someone else's rights.

We may remove results, content or accounts that break these rules, and suspend access if needed.

6. Rankings and public content

Results can appear in rankings for your gym, your country and the world. Your name, country, gym and result are visible there. Story videos can be opened by anyone who has the link, for 7 days.

7. Your content

You keep the rights to logos and other content you upload. You give us permission to show that content within the Service, for example on the boards in the games and in story videos, for as long as you use it. You confirm that you are allowed to use it. People shown in videos you share are your responsibility.

8. The Service

We work to keep the Service running well, but we do not promise that it is always available, free of errors, or compatible with every machine. Machine data can be inaccurate. We can change or improve features. If we stop the Service, we tell you in advance and refund the unused part of prepaid subscriptions.

9. Liability

To the extent the law allows, our total liability is limited to the amount you paid us in the 12 months before the damage occurred, and we are not liable for indirect damage such as lost profit or lost data. This does not apply to damage caused by our intent or deliberate recklessness, or where the law does not allow such a limit.

10. Ending your use

You can stop at any time and delete your account in the Service. We can end an account that seriously or repeatedly breaks these terms. What happens to your data is described in the privacy policy.

11. Apple devices

These terms are between you and us, not Apple. Apple is not responsible for the app, its support or claims about it. If you use the app, Apple's App Store terms also apply. Purchases are not made in the app.

12. Changes and law

We may update these terms. We announce important changes before they take effect. Dutch law applies. Disputes go to the competent court in the Netherlands, without limiting any mandatory consumer rights you have.
